Grewal tells prosecutors to drop marijuana charges

Attorney General Gurbir Grewal directed prosecutors to drop marijuana-related criminal charges a day after Gov. Phil Murphy signed bills legalizing and decriminalizing marijuana use.

His directive orders prosecutors to dismiss possession, distribution, drug paraphernalia and disorderly persons charges, among others, related to marijuana.

In separate interim guidance to police, Grewal advised officers to no longer detain or arrest people for marijuana offenses.

Officers, he said, should issue a summons to individuals found in possession of more than six ounces of marijuana, 17 grams or processed marijuana or who distribute one ounce or five grams of the respective substances.

Grewal also warned officers of the graduated system of warnings for underage users found in possession of marijuana and informed them of new rules barring marijuana odor as a cause for searches.
